| Facilitation
is the use of third party neutrals to help multi-party work groups
accomplish the content of their work by providing process leadership and
process expertise. Facilitators are persons who make a group's work
easier by structuring and guiding the participation of group members. |

| Arbitration is a
method of resolving a dispute between two or more parties.
The parties agree in advance to abide by the decision of the arbitrator.
Arbitrators are impartial persons who are knowledgeable in the area of
controversy and committed to rendering a fair and impartial decision after all
parties have had an opportunity to present their case.
The decision of the arbitrator is final and binding. |

| Mediation is a method of resolving a dispute between two or more parties. The mediator is a neutral third person who acts to encourage and facilitate the resolution of a dispute. The role of the mediator includes, but is not limited to, assisting the parties in identifying issues, fostering joint problem-solving, and exploring settlement alternatives. The parties to the dispute are in control of the final decision, and the decision may or may not be binding. |
ADR is gaining widespread
acceptance as a preferred method of resolving legal disputes since it reduces or directly
avoids expensive court costs and time. Many
state courts, employment contracts, and collective bargaining agreements now
mandate that disputes be resolved via arbitration or mediation.
